Terms of Service

These Terms of Service (“Terms”) govern your use of the Escuchar application and the escuchar.app website, both published by Intrusive Memory Productions (“we”, “us”, or “our”). By downloading, installing, or using Escuchar, you agree to these Terms.
License to Use the App
Subject to these Terms, Intrusive Memory Productions grants you a personal, non-exclusive, non-transferable, revocable license to install and use Escuchar on Apple devices you own or control. You may not redistribute, sublicense, sell, or reverse-engineer the app or its bundled assets.
Audio and Other Content
The audio, transcripts, artwork, and other material you play in Escuchar belong to their respective creators and rights holders. Your license to the app does not grant you any rights to that content beyond listening to it for your personal use. You may not copy, extract, redistribute, or publicly perform content obtained through Escuchar except as its rights holder permits.
Content cached on your device for offline listening is a convenience copy for use within the app, not a download you own.
Acceptable Use
You agree not to use Escuchar to:
- Violate applicable law or infringe the intellectual property rights of third parties.
- Access sources, content, or systems you are not authorized to access.
- Attempt to circumvent any technical protection measures in the app.
Intrusive Memory Productions reserves the right to terminate your license if you violate these restrictions.
Availability of Content
Content is streamed from sources that Intrusive Memory Productions or third parties operate. We do not guarantee that any particular episode, track, or playlist will remain available, and content may be changed, re-released, or removed at any time.
Price
Escuchar is free. There are no in-app purchases, subscriptions, or paid tiers. If paid features are ever introduced, they will be processed through the Apple App Store and governed by Apple’s media services terms and your App Store account settings; Intrusive Memory Productions does not process payment information directly.
No Warranty
Escuchar is provided “as is” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Intrusive Memory Productions does not warrant that the app will be error-free or uninterrupted, or that any content will be available.
Limitation of Liability
To the fullest extent permitted by applicable law, Intrusive Memory Productions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Escuchar, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of Escuchar shall not exceed the amount you paid for the app in the twelve months preceding the claim.
Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction where Intrusive Memory Productions is registered, without regard to conflict-of-law principles. [Governing law jurisdiction — TBD at launch.] Any dispute arising from these Terms shall be resolved in the courts of that jurisdiction.
Changes to These Terms
Intrusive Memory Productions may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the app after an update constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify users (for example, via an in-app notice or an update to the App Store listing).
